12.5 Available Assets for Benefits.
Plan benefits can be paid only to the extent the Plan has adequate resources. No Contributing Employer has any liability, directly or indirectly, to provide Plan benefits beyond the obligation set forth in the Contribution Agreement. Should the Plan have insufficient assets to permit the continued payment of benefits, nothing contained in this Plan shall be construed as obligating any Contributing Employer, Local 6 or the IBEW to make benefit payments or additional contributions beyond what is required by the Contribution Agreement. There is no liability upon the Trustees, individually or collectively as the Board, or upon any other person or entity of any kind, to provide Plan benefits.
