E. EMPLOYER’S FAILURE TO TRANSMIT ELECTIVE DEFERRAL CONTRIBUTIONS.
In the event that an Employer fails to remit your elective deferral contributions and the Plan is unable to recover these contributions, the Plan provides that your account will be credited with these defaulted contributions. In addition, in order to avoid any loss of earnings and/or interest on account of delinquent remittance of your elective deferral contributions, to the extent possible, the Electrical Industry Service Bureau “EISB” will advance elective contributions to your account. In that event, EISB will endeavor to collect the delinquent contribution, and the EISB will be entitled to any interest or liquidated damages due on account of the delinquency. In the event that EISB cannot advance the elective contributions to your account and later collects them in a delinquency action against your employer, interest and liquidated damages on account of the delinquency will be allocated to your account when it is collected by EISB.
